Distance Sales Agreement

Article 1 — Parties

1.2 BUYER The person who creates a Nonda account and places an order. The Buyer's first name, surname and email address are obtained from account details and at the time of ordering.

Article 2 — Subject

This agreement sets out the rights and obligations of the parties concerning the sale and delivery of a digital credit pack purchased electronically by the Buyer through https://nonda.ai, under Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

Article 3 — Service covered by the agreement

3.1. Nonda is an online platform that enables image, video, audio and text generation using artificial intelligence models. Generations on the platform are charged in credits.

3.2. Available credit packs and their prices (excluding VAT) are shown when ordering. Packs at the date of the agreement:

Extra credit packs can only be purchased while a plan is active and expire on the same date as that plan.

Prices are in US dollars and exclude VAT. VAT is added at checkout and the subtotal, VAT and final total are displayed before payment. Turkish card payments are collected in Turkish lira using the Central Bank of the Republic of Türkiye USD selling rate on the payment date; the lira amount is shown in the order summary before payment.

3.3. The credits required for a generation are shown on the platform before it starts. Credits are deducted when the provider completes the generation; credits for generations that cannot be completed for technical reasons are returned.

3.4. Monthly plan credits are valid for 30 days from payment approval. Annual plans are charged in full once at a 20% discount compared with twelve monthly payments. The first monthly credit allocation is released after payment approval; subsequent allocations are released on each calendar-month anniversary over twelve months. Unused monthly credits do not roll over. Plans do not charge again automatically. Team prices and shared credits are multiplied by the current member count shown at checkout. Credits are spent in purchase order (oldest first).

3.5. Credits may only be used for services on the Nonda platform. They cannot be exchanged for cash or transferred to another account. (An administrator transferring their own credits to the team pool is an exception.)

Article 4 — Payment

4.1. Payment is collected in a single charge by credit or debit card through the Nonda checkout form using Tami (a payment service provider and Garanti BBVA subsidiary). The bank’s 3D Secure verification screen is shown within the payment flow.

4.2. Card details are transmitted over an encrypted connection to the Nonda server and immediately forwarded to Tami for payment processing. Nonda does not store card numbers or security codes or write them to application logs.

Article 5 — Delivery

5.1. The credit pack is added immediately and electronically to the Buyer's account after the payment service provider approves the payment. Later annual-plan allocations follow the monthly schedule in Article 3.4. There is no physical delivery.

5.2. If payment approval is delayed, credits are added within a few minutes at the latest after approval.

Article 6 — Right of withdrawal

6.1. Under Article 15(1)(ğ) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for contracts concerning services performed immediately in an electronic environment and intangible goods delivered immediately to the consumer.

6.2. Before ordering, the Buyer expressly acknowledges that credits will be added to their account immediately and that they therefore have no right of withdrawal.

Article 7 — Obligations of the parties

7.1. The Seller must add the purchased credits to the Buyer's account and provide the platform as described in the Terms of Use.

7.2. The Buyer must use the platform in accordance with the Terms of Use and applicable legislation. An account may be closed for a serious violation of the Terms of Use; refunds for unused credits in this case are subject to the provisions in the Terms of Use.

Article 8 — Dispute resolution

For disputes arising from this agreement, Consumer Arbitration Committees at the Buyer's place of residence or where the transaction took place have jurisdiction within the monetary thresholds announced annually by the Ministry of Trade; Consumer Courts have jurisdiction above those thresholds. Applications may also be submitted through the Consumer Information System (TÜBİS) on e-Devlet.

Article 9 — Entry into force

Before confirming the order, the Buyer reads and electronically accepts this agreement and the Preliminary Information Form. The agreement enters into force when the order is confirmed. The agreement text is sent to the Buyer's email address and is accessible from their account.
